DOWNTOWN WELLEN PARK RULES OF CONDUCT

Downtown Wellen Park is privately-owned property.  We welcome all visitors who comply with these Rules of Conduct and our other policies.  We have established these Rules of Conduct to ensure the safe, comfortable, and enjoyable visit of all visitors to Downtown Wellen Park.  Therefore, the following are prohibited on the property:

• Solicitation of any kind, including engaging in commercial activity (such as offering any item for sale), conducting surveys or distributing literature, flyers, samples or other items, conducting interviews, and picketing without the prior, written consent of the owner.
• Protesting, demonstrating or engaging in political or religious demonstrations or displays.
• Disorderly, intimidating, threatening, dangerous or disruptive conduct of any nature, including but not limited to the use of obscene or insulting language or gestures, failing to be fully clothed, loitering, using the downtown as a temporary residence, running, failing to attend to children, yelling, fighting, throwing any objects, littering, rummaging through and/or removing items from trash receptacles, playing radios, musical instruments, or other audio devices, rollerblading, skateboarding, recreational foot scooters, Segways®, hoverboards or similar personal transportation devices. Please note that wheelchairs, motorized scooters and other equipment required by disabled individuals are permitted at any time.
• Gang-related attire or activity, offensive clothing with obscene language or graphics.
• Standing, walking, sitting or moving in such a way as to accost, interfere with, impede or inconvenience others, or in a prohibited area.
• Any act which could result in physical harm to persons or damage to property.
• Any act prohibited by local, state or federal laws or ordinances.
• Possession of an open container or consumption of alcoholic beverages other than in specifically-designated containers purchased by a downtown Wellen Park licensed operator, or possession or consumption of illegal substances.
• Carrying weapons, including, but not limited to firearms, knives, explosives and fireworks of any kind except by on-duty authorized law enforcement personnel.
• Smoking in common areas or other prohibited areas, including electronic cigarettes.
• Defacing, damaging or destruction of property, including writing, spraying, scratching, or affixing decals, stickers or fliers, except as provided by the owner.
• Bringing an unleashed or unruly animal onto the property (except a service animal in the company of a disabled person).
• Photographing, filming or videotaping for business promotion or financial gain while on the property without the prior, written consent of owner.
• Engaging in expressive activity without the prior written consent of owner.

Splashpad Rules of Conduct:

o No food or beverages are permitted on the splashpad
o No glass or animals allowed on/near the splashpad.
o Do not swallow the fountain water; it is recirculated.
o Persons ill with diarrhea should not use the fountain.
o Persons that are not toilet trained must wear swim diapers.
o All users must shower before entering the splash pad.
o The splash pad is an unsupervised facility and all users are using it at their own risk.
o No running, pushing or rough play.
o Children must always have adult supervision.
o No climbing or tampering with equipment.
o Clear the splashpad during inclement weather.
o No bikes, skateboards, rollerblades, etc.
o Water shoes are strongly recommended.
o Splash pad may be closed at any time due to weather or maintenance.

YOUR ENTRY ONTO THE PREMISES OF DOWNTOWN WELLEN PARK CONSTITUTES YOUR CONSENT TO ABIDE BY ALL OF THESE RULES OF CONDUCT. IF YOU FAIL OR REFUSE TO FOLLOW THESE RULES, YOU WILL BE ASKED TO LEAVE THE PROPERTY. VIOLATORS OF THESE RULES OF CONDUCT MAY BE SUBJECT TO EXPULSION, BAN AND/OR ARREST FOR CRIMINAL TRESPASS OR FOR OTHER VIOLATIONS OF LAW. VIOLATORS OF BANNING ORDERS MAY BE SUBJECT TO ARREST AND PROSECUTION FOR CRIMINAL TRESPASS. THESE RULES OF CONDUCT MAY BE AMENDED OR CHANGED AT ANY TIME AND ARE IN ADDITION TO ALL OTHER RULES AND POLICIES PERTAINING TO THE PROPERTY.
